Anderselite are currently recruiting a Cost Draftsman to work with one of our leading clients. Baseline Personnel Security Standard (with a Disclosure Scotland) is required.

Deal with all aspects of costs on cases, Deal with the assessment and payment of adverse costs on behalf of client departments when an order for costs has been made against the client. Providing advice to client departments on all aspects of costs. Providing training internally and externally. Maintain a personal costs case load, Draft statements and bills of costs, negotiate settlements, Deal with adverse costs claims, Draft points of dispute and/or replies, Attend detailed assessment hearings. Prepare budgets.

Key tasks and deliverables:
The Solicitor's Office Costs Team is responsible for the recovery of legal costs awarded to HMRC and the settlement of adverse costs awarded against the Department.
In respect of awards in favour of HMRC the team members draft Schedules of Costs for summary assessment, draft Bills of Costs for detailed assessment, negotiate settlements and if necessary attend detailed assessment hearings. With awards against HMRC the team's role is to assess the claim, draft Points of Dispute, if required, and negotiate a settlement or attend an assessment hearing.
The Team also provides guidance and training on a regular basis to other members of the office and the wider Department.
The team also handles Voluntary Legal Charges (VLC) and Charging Orders which are effectively an HMRC mortgage which is used as a means of securing a tax debt against property.
In very basic terms, the role in relation to VLCs involves : discussing the viability of the case with the relevant business area ; seeking the consent of any prior charge holders (such as banks); drafting the VLC document ; negotiating with the customer's solicitor and arranging for the execution of the VLC and its registration at the Land Registry. The team's role also involves giving a lot of general advice around property issues - VLC's, Land Charges (on unregistered property) and Charging Orders (where debts are secured by a County Court Judgement).

The successful candidate will:
Be required to maximise the costs recovery rate and the savings to the Department with reference to business targets.
Carry out detailed negotiations with legal professionals both inside and outside the Department on complex costs matters and conduct costs assessment hearings in accordance with the relevant Court or Tribunal rules and procedures.
Draft CPR compliant costs budgets.
Contribute from time to time on policy issues.

Experience Required
A sound background in Costs work and/or litigation is highly desirable.
